My husband has joint custody (on his son from a previous marriage) and has recently filed for a temporary modification giving him title as custodial parent. The reason for modification was that his ex's boyfriend is being charged with child abuse for one of his own children ( young toddler) after 4 months in jail and is/was now out on bail living in the same household as my stepson(8). Knowing the mother there is very little possibility that this will be settled out of court. What kind of chances do we have in court even if the mother comes to court saying that she made her boyfriend move out. (we know she loves her son and we don't want to deny him of her but we are looking out for his safety now and over the long run)
