Maggie, his failure to adequately parent COULD be a change in circumstances to modify custody. It, unfortunately, depends on the Judge. Some judges allow each parent to "parent" in their own way during their time. Some judges will consider changing custody in this circumstance. Can you show that homework is not being done or that bedtime is not observed and the kids are doing poorly in school after being with him? Very tough situation! Debra
