Dear Suffering, WOW - what a set of events. First you need to sit down and write a detailed statement of facts explaining what happened. Go into detail about his day to day involvement (or lack thereof ) in the kids' lives. Use this to formulate your response to his papers. You can also ask for things you want related to custody also. Prepare your own proposed parenting plan with you having custody of both kids. "Move away" cases are very complicated and there is conflicting case law about what needs to be shown before you can move with the kids. That is why you need to focus on his involvement with the kids -- the case will really concentrate on that as well as the reasons for your move. It will also depend on the exact terms of your Judgment and any modifications to it. Your kids are old enough so that they can have a say in what happens to them. The temporary custody with him may serve to hurt him in their eyes. Your ex is most likely the legal father of your son.
