My ex and I were divorced in 1992, we have a daughter that is 12 years and my son who is 13 years. (My ex is not his birth father and has known of this before we married. When we divorced he would have it only written on paper that he has physical custody of our daughter and that I have pysical custody of my son. We both have joint legal, which is stated agreeable to each party (vistation, etc.) My dilema and theirs are as follows: My son wants to get to know his birth father, and doesn't wish to stay here in Ca., as well as myself. My daughter has wished to live with me from way back when. Both children have been living with me since 1996. and prior off and on between my house, fathers(ex) and his mom's. My ex came and took my daughter out of school in May 2001 were she was residing with me because he was mad at my son and I for my son finding out about his biological father. For two months he refused to let my daughter contact me / or my family. My son and I moved back east so that I could get settled there and come back and get her (thru the courts) when my son and I came back my ex- went to the courts fabricated all bunches of false statements, that I kidnapped my son, which i have physcial custody of, without his knowledge, he consented to us going. Our divorce says nothing as to the affect each parent has to stay in California..he has taken my kids to Tn, on one occasion to my family for year when his second marriage fell apart. Anyways a judge granted him temporary custody till we go to mediation and court. He has an attorney and I can not afford one. Also the biological father wishes to have rights. I need advice on getting my son back to me Sole custody as well as my daughter. Again they both want to live with me back east...their father is a mind game player and always has been. He never wanted my son...I have proof of school records, officers names of the day my son and left, when his father was right there. Due to the fact he falsed all this stuff to get this temporary orders, can I get him for purjery as well as custody of both of my children. And have all his rights taken away..atleast for my son...so that he can no longer treat them as prisioners.. Please help..
