Jo, I am assuming that the father's parental rights have not been established. Either you or the father can file a "Paternity" action to establish that he is the father. In this action, you can request that custodial rights and child support be determined. See the Articles section of this website for co-parenting guidelines and a sample parenting plan.
You should file the action if you want custody rights determined right away. The court can make "temporary" orders regarding custody.
