This is a typical situation. The best thing to do is attempt to get him to move voluntarily. This can be tried through counseling or mediation. Hopefully he will see the negative effect the situation is having on the child. If this doesn't work you can try court intervention. The court can order a party from a residence on an emergency (ex parte) application if there is physical violence. (If there is physical violence seek legal assistance immediately.) If there is no physical violence the court can order a party to leave the residence on a showing of physical or emotional harm. Judge's differ on the amount of harm necessary to grant the order.
