The best thing to do is attempt to get him to move voluntarily. This can be done through counseling or mediation. If he still refuses to move and the child is suffering you can apply to the court for a "kick out" order. The court can order a person out of the home on an emergency basis (ex parte) if there is physical violence. In the absence of physical violence the court can order a person out of the home if there is emotional harm to the children. Courts vary on the degree of harm necessary. Good luck.
